YOUR AGREEMENT
WITH MAVERIX SNOWCAMP
BOOKING
YOUR HOLIDAY:You must pay a deposit as the minimum guarantee of your
intent to attend the snowcamp, with that effect you will have read
and accepted these terms.
PAYING
FOR YOUR HOLIDAY: You pay a deposit of £99 per person, or full
payment if within eight weeks of departure. You will be sent a balance
paypal request on your confirmation invoice. If your balance is not
received by the due date, your holiday may be considered cancelled
and will be subject to a cancellation fee. On receipt you must check
your confirmation and inform us immediately if it is not correct otherwise
we cannot accept liability for any inaccuracies. Payment receipts
are not issued.
INSURANCE:
It is essential that you travel with a fully comprehensive policy
and acquaint yourself with its terms. Should you or any member of
your party not take insurance, you absolve us of all possible liabilities
and consequences in respect of matters that otherwise would be covered.
YOUR
PASSPORT: If you hold a valid British or EU passport you do not need
a visa or permit for France. It is your responsibility to ensure that
you have a valid passport and, if you are not a British Citizen or
hold an EU passport, to ensure that you have any visa that may be
required.
SPECIAL
REQUESTS: We will endeavour to meet special requests or preferences
but no guarantee can be given. Any request must be shown on your online
booking form but cannot be accepted as a condition of booking unless
specifically agreed by us in writing, to info@maverix.org
DEPARTURE
AND ARRIVAL TIMES: Travel arrangements will be the sole responsibility
of yourself. We will not be held responsible for failure to attend
the camp due travel delays or missed departures or unforeseen travel
issues (Force Majeure). In that respect no refunds will be offered.
YOUR
LUGGAGE: We cannot accept any responsibility for lost or stolen items
in the resort.
ACCOMMODATION:
Accommodation is reserved from mid afternoon on your arrival day into
resort. On your day of departure you will be required to vacate by
1000 hrs. Every effort will be made to provide single rooms, but you
have only have the option to share will one other person.
IF
YOU CHANGE YOUR BOOKING: After our confirmation has been issued, changes
should be notified in writing to info@maverix.org and if we can comply
a charge of £15 per person per change will be made (including
name changes). An alteration within 8 weeks of departure; change of
accommodation / departure date / flight/ or resort, may be considered
as a cancellation and subject to cancellation charges.
IF
YOU CANCEL YOUR BOOKING: If you or any member of your party cancel
your holiday, a charge will be made. We will have incurred expenses
in connection with your holiday and the percentage charge of your
holiday cost will depend upon the time at which written notice of
cancellation is received by us; More than 56 days; Deposit only
56-42 days before departure; 30% (or deposit if higher)
41-29 days before departure; 40%
28-15 days before departure; 65%
14-7 days before departure; 90%
Less than 7 days; 100%
You may change a name (to a suitable client) without incurring any
charges other than a £15 amendment fee, providing 21 days notice
prior to departure is given. Within 21 days cancellation charges as
set out above may apply.
BROCHURE
INFORMATION: It is an express term of your agreement that you have
read these Terms of Agreement and studied the web site www.maverix.org.
All the information on the web site is published by us in good faith
and is believed to be correct and valid at the time of publication.
Unfortunately errors may have occurred and changes taken place affecting
both web site information and prices, it is therefore your responsibility
to check the updated information and prices at the time of booking.
You must understand that certain facilities (inc. entertainment, excursions,
local transport and sporting activities) and services mentioned may
be subject to consumer support, maintenance or weather conditions
and may not be available at certain times in the season.
LIVE
AND LET LIVE: While on holiday you have to consider other people and
your booking is accepted on this understanding. We reserve the right
to refuse admittance and/or re-admittance to the accommodation to
clients who breach any applicable rules or whose behaviour, abuse,
bad language or health in our opinion or that of any person in authority
impairs the comfort, or well being of others, their safety and the
safety of employees, or damage to property.
IF
YOU HAVE A COMPLAINT: If there is something not to your liking whilst
on holiday, you must report it immediately to the supplier of the
services in question and our resort representative, thereby giving
them the opportunity to remedy the problem. We cannot accept liability
in relation to any claim, which does not involve death, injury or
illness if this procedure is not followed.
OUR AGREEMENT WITH YOU
ACCEPTANCE
OF YOUR BOOKING: When we receive your booking deposit, we will send
you confirmation which acts as our acceptance of your booking. A binding
contract between us comes into existence when we issue the confirmation
which is subject to English Law and the jurisdiction of English courts.
OUR
PRICE PROMISE: Whilst everything commercially possible will be done
to avoid the need to levy surcharges, the total holiday price may
however be subject to surcharges in relation to Government or any
other government actions (such as VAT increases), a drop in exchange
rates. Your holiday and all, instruction and lift passes are priced
at the exchange rates listed below. Any drop in the exchange rate
may result in these items being re-invoiced at the revised exchange
rates. In these cases we will absorb a total amount equivalent to
2% of the relevant price (which excludes insurance and amendment charges).
In the unlikely event of needing to surcharge, only amounts in excess
of 2% will be charged plus an administration fee not exceeding £1
and/or an amount to cover travel agents commission. In no circumstances
will any surcharge exceed 10% of the holiday price and you will be
advised no later than 30 days prior to your departure. The prices,
inclusive of VAT, on the web site are calculated on the exchange rates
quoted on www.ft.com on 7 October 2007 in relation to the following
currencies. The exchange rates are: FRANCE: Euro 1.44. We reserve
the right to increase or decrease prices at any time prior to a booking
being made. It is a condition of booking that all ski passes are purchased
from Maverix Snowcamp either in the UK or resort. There is a possibility
of a consumer levy being introduced to provide added protection for
all package holidaymakers. If introduced this will be passed on to
you and will not be subject to our 'Surcharge Guarantee'.
IF
WE CHANGE YOUR HOLIDAY: It is unlikely that we will have to make any
alteration to your booking. However, as holidays are planned months
in advance you will understand that we reserve the right to make changes
to holidays and web site details both before and after you book. If
a significant change to your holiday arrangements is made, we will
advise you as soon as reasonably possible (if there is time before
departure) when you will have the choice of; a. accepting the changed
arrangements or b. purchasing another available holiday from us (and
paying or receiving a refund in respect of any price difference) or
c. canceling your holiday and receiving a full refund of all monies
paid to us. If we do have to make a significant change, one which
involves a change of resort, accommodation to that of a lower standard
or classification, we will pay per person compensation on the scale
set out below:

If
a significant change is made as a result of unusual and unforeseeable
circumstances beyond our control, the consequences of which we could
not have avoided even with all due care which include but are not
limited to those circumstances set out under the heading of "Force
Majeure - Important", compensation we regret cannot be paid.
If we are not given sufficient notice to notify you of a change in
accommodation before your departure, we will pay as a disturbance
fee £10 per person in addition, should it be a significant change,
to the above scale and any difference in the brochure price you may
be entitled to. Minor changes for which compensation will not be paid
include: accommodation to that of the same or a higher standard of
classification.
IF
WE CANCEL A HOLIDAY: We may sometimes be forced to cancel a holiday
as all holidays operate subject to a minimum number of clients. We
will not however cancel your holiday less than eight weeks before
departure, unless we are forced to do so as a result of "Force
Majeure" as described in these conditions. In the event of cancellation,
we will notify you as quickly as possible and except where cancellation
is due to your default in payment we will then offer you the same
choice as "If we change your holiday" for a significant
reason. A situation could arise, whereby circumstances amounting to
"Force Majeure" as defined in these conditions forced us
to curtail your holiday after the date of departure. In such a very
unusual situation we regret that beyond any money recoverable by us
we could not make any refunds or pay compensation or be responsible
for any costs or expenses incurred by you.
DEALING
WITH COMPLAINTS: In the event of a complaint we will try to settle
it swiftly and amicably.
OUR
LIABILITY TO YOU: We accept responsibility for ensuring your holiday
is supplied as described on the web site subject to your agreement
with us and that services offered reach a reasonable standard. If
any part is not provided as promised we will pay you appropriate compensation
if this has affected the enjoyment of your holiday. We accept responsibility
for the act and/or omissions of our employees, agents and suppliers
when acting within the scope of their employment except where they
lead to death, injury or illness. Our liability however is in all
cases limited to twice the price of the holiday excluding insurance
premiums and amendment charges of the person affected. Except where
accommodation only is booked, we accept the responsibility should
you or any member of your party suffer death, injury or illness as
a result of any failure to perform or improper performance of any
part of our contract with you by any of our employees, agents, suppliers
or sub-contractors (providing they were at the time carrying out work
authorised by us) except in the following situations. We will not
be liable where any failure to perform or improper performance was
due to (a) the acts and/or omissions of the person(s) affected or
(b) those of a third party not connected with the provision of your
holiday and which were unforeseeable or unavoidable or (c) an event
which either ourselves or the supplier of the service(s) in question
could not have foreseen or avoided even with all due care. It is however
a condition of our acceptance of these responsibilities that you notify
us of any claim within 28 days of your return from your holiday and
that, where any payment is made, the person affected will assign to
us or our insurers any rights they may have to sue any third party
and to extend to us full co-operation. If any client (except where
accommodation only is booked) suffers death, illness or injury whilst
overseas arising out of activity which does not form part of the foreign
inclusive holiday arrangement nor an excursion arranged through us,
we shall, at our discretion, offer advise, guidance and assistance
to help you in resolving any claim you have against a third party,
provided we are advised of the incident within 90 days of the occurrence.
Where legal action is contemplated our authority must be obtained
prior to commencement of proceedings and be subject to your undertaking
to assign any costs recovered or any benefits received under an appropriate
insurance policy to ourselves. Our costs in respect of the above on
behalf of you and your party shall not exceed £5,000 in total.
FORCE
MAJEURE - IMPORTANT: Liability cannot be accepted where delays, changes
or cancellations or the non-performance or improper performance of
our obligations in whole or in part, are caused by events amounting
to Force Majeure, (i.e. any event which we or the supplier of the
services in question could not, even with all due care, foresee or
avoid.) This includes events such as war or threat of war, riots or
civil strife, terrorist activity, industrial disputes, natural or
nuclear disaster, fire, adverse weather, poor snow conditions, high
winds, traffic conditions or mechanical failure or other circumstances
amounting to Force Majeure. We will of course use our best endeavours
to help resolve any situation.
BROCHURE VALIDITY: Holidays on this web site operate within the period
June 2008 - July 2008.
